This Agreement constitutes the entire and only agreement between us and you, and supersedes all prior or contemporaneous agreements, representations, warranties and understandings with respect to the Site, the content, products or services provided by or through the Site, and the subject matter of this Agreement. This Agreement may be amended at any time by us from time to time without specific notice to you. The latest Agreement will be posted on the Site, and you should review this Agreement prior to using the Site.

Copyright

The content, organization, graphics, design, compilation, magnetic translation, digital conversion and other matters related to the Site are protected under applicable copyrights, trademarks and other proprietary (including but not limited to intellectual property) rights. The copying, redistribution, use or publication by you of any such matters or any part of the Site is strictly prohibited. You do not acquire ownership rights to any content, document or other materials viewed through the Site. The posting of information or materials on the Site does not constitute a waiver of any right in such information and materials. Some of the content on the site is the copyrighted work of third parties.

Service Marks

“MALIBAL” and others are our service marks or registered service marks or trademarks. Other product and company names mentioned on the Site may be trademarks of their respective owners.

Limited License

You are granted a non-exclusive, non-transferable, revocable license:

1. To access and use the Site strictly in accordance with this Agreement;
2. To use the Site solely for internal, personal, non-commercial purposes;
3. To print out discrete information from the Site solely for internal, personal, non-commercial purposes and provided that you maintain all copyright and other policies contained therein.

No print out or electronic version of any part of the Site or its contents may be used by you in any litigation or arbitration matter whatsoever under any circumstances.

Restrictions and Prohibitions on Use

Your license for access and use of the Site and any information, materials or documents (collectively defined as “Content and Materials”) therein are subject to the following restrictions and prohibitions on use:

You may not:

1. Copy or Distribute: Copy, print, republish, display, distribute, transmit, sell, rent, lease, loan or otherwise make available in any form or by any means all or any portion of the Site or any Content and Materials retrieved from it.

5. Remove Notices: Remove, change or obscure any copyright notice or other proprietary notice or terms of use contained in the Site.
6. Unauthorized Access: Make any portion of the Site available through any timesharing system, service bureau, the Internet or any other technology now existing or developed in the future.
7. Reverse Engineering: Remove, decompile, disassemble or reverse engineer any Site software or use any network monitoring or discovery software to determine the Site architecture.
8. Information Harvesting: Use any automatic or manual process to harvest information from the Site.
9. Unsolicited Communications: Use the Site for the purpose of gathering information for or transmitting:
a. Unsolicited commercial email
b. Email that makes use of headers, invalid or nonexistent domain names, or other means of deceptive addressing
c. Unsolicited telephone calls or facsimile transmissions
10. Legal Violations: Use the Site in a manner that violates any state or federal law regulating email, facsimile transmissions or telephone solicitations.
11. Export Violations: Export or re-export the Site or any portion thereof, or any software available on or through the Site, in violation of the export control laws or regulations of the United States.

Violation of these restrictions and prohibitions may result in the termination of your access to the Site and potential legal action.

Linking to the Site

You may provide links to the Site, provided (a) that you do not remove or obscure, by framing or otherwise, advertisements, the copyright notice, or other notices on the Site, (b) your site does not engage in illegal or pornographic activities, and (c) you discontinue providing links to the Site immediately upon request by us.

Registration/Purchase

Certain sections of, or offerings from, the Site may require you to register. If registration is requested, you agree to provide us with accurate, complete registration and/or purchase information. Your registration must be done using accurate information.

Each registration is for your personal use only. We do not permit:

1. Any other person using the registered sections under your name; or
2. Access through a single name being made available to multiple users on a network.

You are responsible for preventing such unauthorized use.

Errors, Corrections, and Changes

We do not represent or warrant that the Site will be error-free, free of viruses or other harmful components, or that defects will be corrected. We do not represent or warrant that the information and/or pricing available on or through the Site will be correct, accurate, timely or otherwise reliable. We may make changes to the features, functionality or content of the Site at any time. We reserve the right in our sole discretion to edit or delete any documents, information or other content appearing on the Site.

Pricing changes very frequently on the Site. If an order is placed and the price drops before the system ships, the customer may request to have their invoice updated with the lower price, however, no change will be made unless a request is submitted by the customer. Once an order has shipped, we cannot make any changes to the pricing on the invoice.

Unlawful Activity

We reserve the right to investigate complaints or reported violations of this Agreement and to take any action we deem appropriate, including but not limited to reporting any suspected unlawful activity to law enforcement officials, regulators, or other third parties and disclosing any information necessary or appropriate to such persons or entities relating to your profile, email addresses, usage history, posted materials, IP addresses and traffic information.

Indemnification

You agree to indemnify, defend and hold us and our partners, agents, officers, directors, employees, subcontractors, successors, assigns, third party suppliers of information and documents, advertisers, product and service providers, and affiliates (collectively, “Affiliated Parties”) harmless from any liability, loss, claim and expense related to your violation of this Agreement or use of the Site.

Nontransferable

Your right to use the Site is not transferable or assignable. Any password or right given to you to obtain information or documents is not transferable or assignable.

Disclaimer

THE INFORMATION, CONTENT AND DOCUMENTS FROM OR THROUGH THE SITE ARE PROVIDED “AS-IS,” “AS AVAILABLE,” WITH “ALL FAULTS,” AND ALL WARRANTIES, EXPRESS OR IMPLIED, ARE DISCLAIMED (INCLUDING BUT NOT LIMITED TO THE DISCLAIMER OF ANY IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE). We will not be required to treat any Submission as confidential, and will not be liable for any ideas (including without limitation, product, service or advertising ideas) and will not incur any liability as a result of any similarities that may appear in our future products, services or operations.

Without limitation, we will have exclusive ownership of all present and future existing rights to the Submission of every kind and nature everywhere. We will be entitled to use the Submission for any commercial or other purpose whatsoever, without compensation to you or any other person sending the Submission.

You acknowledge that you are responsible for whatever material you submit, and you, not us, have full responsibility for the message, including its legality, reliability, appropriateness, originality, and copyright.

Payments

You represent and warrant that if you are purchasing something from us or from Merchants that (i) any credit information you supply is true and complete, (ii) charges incurred by you will be honored by your credit card company, and (iii) you will pay the charges incurred by you at the posted prices, including any applicable taxes.

The Site contains information and press releases about us. We disclaim any duty or obligation to update this information or any press releases. Information about companies other than ours contained in the press release or otherwise, should not be relied upon as being provided or endorsed by us.

Legal Compliance

You agree to comply with all applicable domestic and international laws, statutes, ordinances and regulations regarding your use of the Site and the Content and Materials provided therein.

Refusal of Business

We reserve the right to refuse business to anyone and/or to cancel an order at any time.

Miscellaneous

This Agreement shall be treated as though it were executed and performed in Las Vegas, Nevada, and shall be governed by and construed in accordance with the laws of the State of Nevada (without regard to conflict of law principles).

Any cause of action by you with respect to the Site (and/or any information, Documents, products or services related thereto) must be instituted within one (1) year after the cause of action arose or be forever waived and barred. All actions shall be subject to the limitations set forth in Section 16 and Section 17.

The language in this Agreement shall be interpreted as to its fair meaning and not strictly for or against any party. Any rule of construction to the effect that ambiguities are to be resolved against the drafting party shall not apply in interpreting this Agreement.

This Agreement and all incorporated agreements and your information may be automatically assigned by us in our sole discretion to a third party in the event of an acquisition, sale or merger.

If any provision of this agreement is held illegal, invalid or unenforceable for any reason, that provision shall be enforced to the maximum extent permissible, and the other provisions of this Agreement shall remain in full force and effect. If any provision of this Agreement is held illegal, invalid or unenforceable, it shall be replaced, to the extent possible, with a legal, valid, and unenforceable provision that is similar in tenor to the illegal, invalid, or unenforceable provision as is legally possible.

To the extent that anything in or associated with the Site is in conflict or inconsistent with this Agreement, this Agreement shall take precedence. Our failure to enforce any provision of this Agreement shall not be deemed a waiver of such provision nor of the right to enforce such provision.

Our rights under this Agreement shall survive any termination of this Agreement.

The title, headings and captions of this Agreement are provided for convenience only and shall have no effect on the construction of the terms of this agreement.

Reselling

We operate on a direct-to-customer model, which means that there are no authorized MALIBAL dealers or resellers, so if you see a company selling our laptops – please report them to us. We do not allow the purchase of our laptops for resell.

Returns

Any laptop purchased from MALIBAL may be returned or exchanged only in accordance with MALIBAL’s return policy in effect on the date of the invoice or acknowledgement.

Return Process

1. Contact us directly before attempting to return a laptop to obtain a Return Material Authorization Number.
2. Return the laptop in its original packaging and condition, with all included manuals, discs, accessories, etc.
3. All returns will be inspected for physical damage and thoroughly tested for compliance with our policies.

Conditions for Refund

– Original boxes with all packing material must be returned without tearing, cutting, or markings.
– Any cost to replace damaged or missing parts will be deducted from your refund total.
– We must receive the laptop back within 30 days from the shipment date to qualify for a refund.

100% Money-Back Guarantee

– Valid once per product, on laptops that we preload with an OS we support.
– Mac users experimenting with a new OS, users installing an unsupported OS, or those buying solely for review purposes may be subject to a 20% restocking fee.

Shipping Fees

– Return shipping fees are only refundable in the lower US states.
– Expedited shipping fees (UPS Next Day, UPS 2 Day, UPS 3 Day, etc.) are non-refundable.

Exceptions

– Laptops with permanent customizations are non-refundable.

Important Notes

– MALIBAL is not responsible for laptops that are lost, damaged, modified, or processed for disposal or resale if return instructions are not followed.
– Credit for returns may be less than invoice or individual component prices due to bundled or promotional pricing, including free shipping.

Refunds

The timeline from the cancellation of your order or the receipt of your returned laptop to the reimbursement being reflected on your card or account generally spans 5-15 business days.

Please note that this duration is an estimate and can be subject to extension due to various factors. These factors include, but are not limited to, holiday periods, our current production schedules, and other external circumstances that may affect processing times.

Note: Cash payment orders, i.e., checks or bank wires, may be subject to a small deduction to cover transfer fees.

Cancellations

If you request an order cancellation within 24 hours of placing the order, there will be no cancellation fee. For cancellations requested after 24 hours of order placement, a cancellation fee of 5% to 10% will apply, depending on the stage of the order process.

Sales Tax

All residents in the state of Nevada must pay state sales tax based on their location.

Bans

We reserve the right to suspend or terminate user accounts at our discretion.

Grounds for banning may include, but are not limited to:
– Violations of our terms of service
– Disruptive behavior
– Misuse of our platform
– Any actions that, in our judgment, pose a risk to the integrity and security of our company

1. Appeals: Bans are permanent and cannot be appealed under any circumstances.
2. Warranty and Support: If a banned user has remaining warranty and support on a purchased product, they can still access these benefits through our support channels as outlined in our warranty and support policies.
3. Future Purchases: Once banned, the user is permanently prohibited from purchasing any MALIBAL products or services for life without exception.
4. Circumvention: Any attempt to circumvent a ban, including but not limited to having another user purchase products on behalf of a banned user, will result in:
– A permanent ban for the assisting user
– Voiding of warranty and support for the banned user’s products

Enforcement: We take our ban policy seriously and will enforce it strictly to maintain the integrity of our platform and protect our community of users.

Parts Substitution

We reserve the right to use different brands or manufacturers of parts of equal or greater value in the provision of our services, depending on part availability. While we strive to maintain consistency in the quality and performance of the parts used, variations in brand or manufacturer may occur. Rest assured that any substitutions made will be made with careful consideration to ensure they meet or exceed the specifications of the original part.

Geographical Restrictions

The products and services offered on www.malibal.com are not available for purchase by residents of the State of California. If you are a resident of California, you are expressly prohibited from buying any products or services from this website. This prohibition includes any attempts to circumvent this restriction by shipping products to an address outside of California with the intention of forwarding them to a California address, as well as purchasing products while you are temporarily located outside of California with the intention of bringing them into the state. We reserve the right to refuse service or cancel orders that we determine are in violation of this policy.

Use of Google Products and Services

Users are prohibited from accessing this website using any Google products or services. This includes, but is not limited to, the following:

1. Gmail: Users may not use Gmail to register, login, or otherwise interact with this site.
2. Google Chrome: Users may not use the Google Chrome web browser to access this site.
– Exception: De-Googled forks of Chrome are allowed.

Grandfathered Accounts
Users who had Reddit accounts prior to December 6, 2024, may retain ownership of these accounts provided they:
1. Cease all active participation on the platform from the effective date
2. Do not access or use any Reddit services from the effective date
3. Do not provide any form of support to Reddit from the effective date

Duration
This restriction remains in effect indefinitely. Users must cease all Reddit-related activity as defined above from December 6, 2024, before accessing our services.

Enforcement
Violation of this policy may result in immediate account termination and forfeiture of any associated services or benefits. We reserve the right to implement additional measures to enforce this policy as deemed necessary.

Exceptions
No exceptions to this policy will be granted unless explicitly authorized in writing by site administration.

Alternatives

Are all the parts soldered to the motherboard?

In many modern laptops, especially thin and light models (like Apple’s MacBook Air or Pro, Dell’s XPS 13, or many of Lenovo’s ThinkPad X1 Carbon models), the memory, storage, battery, and wireless module are often soldered directly onto the motherboard.

However, as part of our commitment to the Right to Repair Movement, the memory, storage, battery, and wireless module on all MALIBAL laptops are user-upgradeable or user-replaceable.

Can your laptops be charged or powered via USB-C?

All MALIBAL laptops can be powered via the Thunderbolt 4 port.

How do I track my order after it ships?​
You can view your tracking status via the order details page in your account.
How do I get a quote?

If you need a quote for any reason, e.g., to submit to accounting for approval, before ordering, simply add the laptop(s) you want to purchase to the Cart, then click Checkout, and on the checkout page, click Convert Cart to Quote. We will email you a PDF of the quote with a link to make payment once you are ready to complete the order.

How do I cancel an order?

You may cancel an order any time up until it ships. After it ships, you will not be able to cancel it, but will instead have to use our return policy in order to return the laptop for a refund. To cancel an order, simply open a sales ticket or sales chat and give the representative your order information, and they will cancel the order for you and send you confirmation via email and text.

How do I make a change to my order?

You may make changes to your order up until it ships. To modify an order, simply open a sales ticket or sales chat and give the representative your order information and specify which changes you want to make.

When is my order shipping?

If all parts are in stock, the average build time for laptops is 5-7 business days. This means laptops will ship 5-7 business days after the order is placed. If a component is backordered, it will say which parts are backordered in your order confirmation email.

To see the estimated delivery date of your laptop, please check your order confirmation email for the Estimated Delivery Date. You can also see this information on your My Account > Order Details page. The estimated delivery date is the build time (plus backorder delay, if applicable) plus the shipping time.

Once your laptop ships out, we will email you the tracking information. An adult will need to be at the address to sign for the package when it arrives.
